
The proposed development (2023)
Perth CAO Michael Touw issued a statement regarding the ongoing Ontario Land Tribunal case with Caivan Limited about their proposed residential development.
“As the Town continues to move through the process at the Ontario Land Tribunal (OLT) following Caivan’s appeal to that provincial body, I recognize that many in our community
have questions about process and what can be released and when. Because the OLT process is a legal proceeding (similar to Court), there are strict guidelines about what can be released, and when. I want to assure residents that Council is committed to transparency, responsible development, and our community. As soon, and as often, as we are able, we will continue to release and publish information. The best way to keep up to date is to subscribe to updates on our Engage Perth platform.”
Caivan (Perth GC) Limited initially submitted a planning application, deemed complete on May 8, 2023, with a public meeting held on August 10, 2023, to gather feedback from
agencies and the public. In September 2023, CAIVAN appealed the Zoning By-law Amendment and Plan of Subdivision to the Ontario Land Tribunal (OLT).
Since then, three Case Management Conferences (CMC) have been held, and a fourth is scheduled for November 19, 2024. The merit hearing, initially set for August 2024, has been rescheduled to February 2025 to allow the developer time to gather additional
information.
During the most recent CMC held on Friday, Sept. 13, the following took place;
• Parties agreed that the revised Draft Procedural Order and Issues List is to be submitted to the OLT by Friday, Nov. 15. The Draft Procedural Order and Issues list, identifies who may participate in the hearing, the issues in dispute, and what matters
must be conducted before the hearing.
• A date for a fourth CMC has been set for Tuesday, Nov. 19, beginning at 10 a.m. During this CMC, the Tribunal will set an updated deadline for Participant Statement re-submissions based on the revised conceptual Draft Plan of Subdivision (DPS), Official Plan Amendment (OPA), and Zoning By-law Amendment (ZBA).
